Welcome to pineconstruct.com (the “Site”). These Terms & Conditions (“Terms”) form a binding agreement between you (“you” or “User”) and Pine Construction (“Pine Construction,” “we,” “our,” or “us”). By accessing or using the Site, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy.

1  Acceptance & Electronic Signatures

Using any part of the Site—including clicking “Submit” on a form—constitutes acceptance of these Terms. Electronic actions are the legal equivalent of handwritten signatures.

2  Informational Disclaimer

Site content is for general information only and does not constitute professional, legal, or construction advice. Illustrative estimates and timelines are non‑binding until incorporated into a mutually‑executed written project agreement (“Project Agreement”).

3  Intellectual Property

All text, graphics, photos, videos, and code on the Site are the property of Pine Construction or its licensors and are protected by U.S. copyright and trademark laws. You may view or print content for personal reference; any commercial use without written consent is prohibited.

4  User Conduct, Content License & Indemnification

You agree not to:

  1. Upload or transmit unlawful, defamatory, or infringing content;
  2. Introduce malware or disrupt the Site;
  3. Use automated scripts to harvest data without consent;
  4. Misrepresent your identity or affiliation.

Content License. By submitting or uploading any content to the Site (including project photos, drawings, or comments), you grant Pine Construction a perpetual, worldwide, non‑exclusive, royalty‑free license to use, reproduce, modify, adapt, publish, and display that content for the limited purposes of (i) performing or marketing our services, and (ii) operating the Site. Where required by law, we will request separate consent before using content for marketing.

Indemnification. You will indemnify and hold harmless Pine Construction and its officers, employees, and contractors from any claims, damages, and expenses (including attorneys’ fees) arising out of (i) content you submit; (ii) violation of these Terms; or (iii) misuse of the Site.

5  Construction‑Specific Disclaimers

  1. Permits & Codes. Compliance responsibilities and costs are defined in your Project Agreement.
  2. Site Conditions. Estimates assume ordinary conditions; hidden issues may require change orders.
  3. Weather & Seasonal Delays. Schedules may shift due to weather, supply shortages, or similar factors.
  4. Material Pricing Volatility. Quoted prices are valid only for the period stated in your Project Agreement.

6  Quotes & Project Agreements

Work is governed solely by a written Project Agreement. If these Terms conflict with a Project Agreement, the latter controls.

7  Warranties & Disclaimers

The Site is provided “AS IS” and “AS AVAILABLE.” Pine Construction disclaims all warranties regarding Site accuracy or availability. Workmanship and product warranties are detailed exclusively in your Project Agreement.

8  Limitation of Liability

To the fullest extent permitted by law, Pine Construction will not be liable for indirect, incidental, special, or consequential damages. Direct damages, if awarded, shall not exceed the greater of (a) US $5,000 or (b) the total fees you paid Pine Construction in the twelve (12) months preceding the claim.

9  Force Majeure

Pine Construction is not liable for delay or failure to perform due to causes beyond our reasonable control, including natural disasters, pandemics, governmental actions, labor disputes, supply‑chain disruptions, or power outages.

10  Third‑Party Links & Tools

The Site may link to external sites or services. Pine Construction does not endorse and is not responsible for third‑party content or practices. Use them at your own risk.

11  Data Privacy & Security

Pine Construction employs commercially reasonable security measures as described in our Privacy Policy. However, no system is completely secure. To the extent permitted by law, Pine Construction disclaims liability for any unauthorized access to or loss of personal information transmitted to or stored on the Site. Your use of the Site is at your own risk.

12  Data Export, Suspension & Termination

  • Export/Delete Requests. Email pineconstruct@gmail.com to export or delete project documents you have submitted. Verified requests will be honored per our Privacy Policy.
  • Suspension/Termination. Pine Construction reserves the right, in its sole discretion, to suspend or terminate any User’s access to the Site for violation of these Terms or to protect the integrity or security of the Site.

13  Severability

If any provision of these Terms is held invalid, the remaining provisions remain in full force and effect.

14  Governing Law & Dispute Resolution

These Terms are governed by Tennessee law. The parties will attempt good‑faith mediation in Davidson County, Tennessee before litigation. Any suit shall be filed exclusively in the state or federal courts located there, and the parties consent to those courts’ jurisdiction.

15  Modifications to Terms

We may update these Terms at any time. Changes will be posted with a new “Effective Date.” Continued use of the Site after changes constitutes acceptance.
